Is HTC's A9 the One? [review]


So you bought iPhone 6. You love the understated styling of the aluminum enclosure and how the device feels in your hands. But iOS is a dog brain. It's loyal and friendly, but you want more than a tail-wagger that needs to be let out to pee. HTC has your back, with the shockingly similar-looking One A9. The imitator gives you close-enough design benefits with the extra bang of the freshest Android (Marshmallow).
Over the Black-Friday-to-Cyber-Monday weekend, one in ten A9 buyers moved up from iPhone 6 or 6s series devices, according to HTC. The manufacturer has a holiday special ending Jan. 7, 2016 that allures some switchers. Trade-in one of the Apples for full discount off the A9's purchase price (HTC mails a $499.99 check after receiving the old device). Galaxy S6 and S6 Edge traders get $200 and LG3 and LG4 owners $100.
HTC One A9 is the iPhone 6s for Android


Without even turning on the HTC One A9 (which I haven't yet), the physical similarities with iPhone 6/6s are unmistakable. The smartphones share striking design ethic, separated by the shape of the home-button fingerprint sensor, placement of the rear-facing camera, and left-side SIM and microSD card slots. But these differences aren't immediately obvious.
My question: Is this the Android for people wanting the iPhone 6s look but something more flexible than the iOS platform? If there is truth in marketing, HTC's tag lines reveal much: "Design worth imitating", which while referring the company's One legacy also could be interpreted as backhanded praise or even fist-to-snub about Apple's device, which some could argue imitates earlier One models. "Power to choose"—customization and personalization options not offered on fruit-logo handsets.
Why Apple no longer innovates


The more I ponder Apple's Beats acquisition, the less sense it makes. Buying big well-known brands that compete with yours is usually a bad idea -- worse when the acquirer owns no foreign brands. Extinguishing the big name, as Microsoft does with Nokia, is marketing murder. There's no place for the Beats brand in the Apple lexicon. The gun is drawn and ready to fire.
What I do see is another sign that Apple has lost its way. Tim Cook is a very able CEO, but as stated previously he is Star Trek's Spock without Captain Kirk (Steve Jobs). Cook's approach to business logistics, while brilliant, unmakes Apple. Beats is an acquisition that is off-key -- out of tune with the culture that made the fruit-logo company great. As such, on this Thursday in May, comes my confession. I was wrong five years ago in post "Why Apple succeeds, and always will". That company is gone.
You can have Apple iPhone 5s, I'll take HTC One M8


Many new smartphone shoppers will compare the HTC One M8 and Samsung Galaxy S5, which are about the same size, offer similar high-end features, run Android (with customized user interfaces), and arrived in U.S. retail stores within days of one another. But since I move from iPhone 5s to what henceforth will be referred to as The One, the two devices are uniquely attractive, and both pack bleeding-edge cameras, my comparison is more Apple to oranges. If iPhone 5s is high up your shopping list don't buy without first considering The One. It's my choice, although granted it might not be best for you.
I moved from the original One, the M7, to the 5s a few months ago. You might laugh at the reason. I find that my daughter, who shuns Androids for Apples, is more likely to text message when we both use iPhones. She is away at college. But the 5s, like iPhone 5, immediately disappointed for phone calling. Reception tends to breakup in my neighborhood on both devices, using AT&T or T-Mobile. Calling is superior and adequate on either One, and even better on the Moto X. The One illuminates the Apple's inadequacies, which simply are unacceptable coming from the company that popularized touchscreen smartphones.
iPhone's problem isn't bleeding market share


The magic is gone. As recently as mid-2012, rumors of a new iPhone was command performance -- bloggers and social networkers rushed every little bit of spec speculation to the web. A year later, has-beens are kings. Buzz belongs to the once high and mighty: HTC, Motorola, Nokia and Sony, each a former market-share commander. These companies are all something Apple, and even Samsung, is not: Hungry. Pride goes before the fall, they say. Pride brought down the big four (five, including BlackBerry), as their execs laughed off iPhone's launch in June 2007. They laugh again, as their companies bring truly innovative mobiles to market and Apple acts much as they did six years ago.
The fruit-logo company has a huge problem that is core to future competition. For nearly a decade, Apple benefitted from free-marketing, as enthusiast tech bloggers and reporters and over-eager Wall Street analysts and investors fanned the smallest flicker of rumor into raging fire. Now Android rises, like one of those robots in "Pacific Rim", to crush the iPhone monster. Meanwhile, Apple's humbled stock price gets less bang from rumors. CEO Tim Cook signaled three months ago that new "innovations" won't come until autumn -- and there are no leaks to rally the faithful against the horde of Android and Windows Phone infidels. The problem isn't bleeding market share -- a circumstance in most every market outside the United States -- but one of bleeding mindshare.
Apple and HTC settle patent dispute


Tonight, Apple and HTC ended their longstanding patent litigation. The agreement terminates all litigation and establishes cross-licensing of patents current and future for 10 years. The deal raises questions about whether Apple might step back from its aggressive litigation, working with competitors. Cross-licensing intellectual property tends to be mutually beneficial, and it's a tactic long pursued by Microsoft.
"We are glad to have reached a settlement with HTC", Apple CEO Tim Cook, says. "We will continue to stay laser focused on product innovation". HTC CEO Peter Chou remarks: "HTC is pleased to have resolved its dispute with Apple, so HTC can focus on innovation instead of litigation".
Watch out, Apple, HTC is coming for you


HTC is like a child with shiny new toy taken from HP and used against neighborhood bully Apple. Enjoying its December 2011 patent purchase, yesterday the Taiwanese smartphone manufacturer filed a counterclaim in a Florida court, accusing Apple of infringing on two patents. HTC wants to keep momentum after a win against Apple in a UK court, invalidated the famous "slide to unlock" patent.
Apple has targeted major competitors -- HTC, Motorola Mobility and Samsung primarily -- with patent infringement lawsuits. While counterclaims are common, HTC has so far mostly been on the losing end against Apple. HTC purchased two patents -- US Patent No. 7,120,684, titled "Installation of network services in an embedded network server", and 7,571,221, named "Method and system for central management of a computer network". Both patents are claimed to be infringed by the fruit company.
You are collateral damage in the patent wars


The patent is mostly a good thing, right? It is a way to show recognition for all the work an individual puts into developing something completely new. It’s useful in determining who creates and who copies. The system may have its kinks, but it’s a good one overall. We revolve around it each day whether we know it or not.
A patent is an easy way to make money, but these days not so much for inventing things but inventing concepts to patent. To make money from them, usually someone has to get sued. The process involves a considerable amount of money, starting with paying lawyers, paying court costs, paying for transport, hotels, meals, and so on. All these things add up and they account for every cent as to what a trial would and does cost.
I'm boycotting Apple


Patent bullying and ongoing competition by litigation and intimidation are reasons why. For me the last straw came earlier this week when Apple sought to ban importation of Samsung Galaxy S III (the request for preliminary injunction is before a judge and a ruling could come as early as next week). The phone launched in 28 countries on May 29 and goes on sale from five US carriers within the next 30 days. Many tech reviewers and pundits have called Galaxy S III an iPhone 4S killer. Apple doesn't have a competitive product in market so instead seeks to block Samsung's -- all under the guise of protecting innovations.
Apple is an amazing marketer that manages perceptions very well. One of these regards innovation and the idea that other companies imitate Apple, often badly, and its trendy ideas must be protected. Perception is one thing. Reality is another. Apple isn't as innovative as its corporate "reality distortion field" would have everyone believe. But the company has gotten quite good at something: Unleashing a torrent of suits to secure patents and to defend them -- and many cover processes that should never have been awarded patents in the first place. Apple has gotten quite good at gaming the patent system. I want no part of it.
HTC says some of its blocked phones have passed customs


Last week, the news broke that some of HTC's new Android smartphones, including the One X and EVO 4G LTE were being held up in U.S. Customs for potentially violating an ITC exclusion order.
HTC last Wednesday confirmed that these two phones were delayed due to "a standard U.S. Customs review of shipments" that was required as a result of the ITC order. The company said "We believe we are in compliance with the ruling and HTC is working closely with Customs to secure approval." The customs delay caused the launch of the EVO 4G LTE to be postponed.
Apple patents block HTC One X and EVO 4G LTE from U.S. market


"The US availability of the HTC One X and HTC EVO 4G LTE has been delayed due to a standard U.S. Customs review of shipments that is required after an ITC exclusion order," a boilerplate statement from Taiwanese smartphone maker HTC said on Wednesday.
The company's flagship smartphones are being held up in customs as a result of patent litigation with Apple, and their availability to consumers is currently on hold. Though it only launched on May 6, AT&T currently lists the One X as "sold out," and Sprint's EVO 4G LTE which was slated to launch on Friday, May 18, will be delayed. Pre-orders of the device do not have a guaranteed ship date.
Samsung smartphone shipments soar stunning 267%, trouncing iPhone


Apple apologists' brief respite is over. Late last week, IHS iSuppli and Strategy Analytics released first quarter data putting Samsung handset shipments ahead of Nokia, ending the Finnish company's 14-year reign. But the analyst firms couldn't agree on smartphones, with Strategy Analytics positioning Samsung ahead of Apple, but IHS giving the nod to iPhone. The Apple Fanclub clung to the "We're No. 1!" data, unsurprisingly. But the last word comes today from IDC, which corroborates Strategy Analytics, crowning Samsung king in both categories.
"The halcyon days of rapid growth in the smartphone market have been good to Samsung", Kevin Restivo, IDC senior research analyst, says. "Samsung has used its established relationships with carriers in a mix of economically diverse markets to gain share organically and at the expense of former high fliers such as Nokia".
